Terms and Conditions of Service

1. Contract Terms We offer to provide one-to-one telephone and in person coaching services (“Coaching Services”) to you on the terms that follow. If you place an order with us for coaching services then, unless we notify you that we do not accept your order, a legally binding contract will be formed between you and Winning Ways (“we”, “us” or “Winning Ways”). The terms of that contract are as set out here, together with any representation that we have made about the Coaching Services on our website. All other terms and conditions contained in any other document, and all other representations, are excluded unless their inclusion is expressly agreed in writing. Appointments for each coaching session will be arranged by a staff member of Winning Ways. 24 hours notice is needed to cancel or rearrange an agreed appointment. 2. Cancellation Right & Money Back Guarantee If you are dissatisfied in any way with a coaching session that we provide to you, then we will refund your payment for that coaching session and for any unused coaching sessions, as long as you follow your homework assignments. You may also cancel your order at any time and receive a full refund for any unused coaching sessions. However, you need to know that you will only benefit from the Winning Ways Programs if you commit to completing your assignments in a timely manner and utilize a positive and open-minded attitude. As a result of you diligently working our program, we will then happily guarantee our work with a Money Back Guarantee. To claim a refund, just send an email asking for it to marge@discoverwinningways.com.  We will issue the refund within 7 days of your request. 3. Payment 3.1. Your introductory consultation will be provided free of charge. We will only charge for additional coaching sessions that you decide to take up. Each client receives a customized program, based on need. Therefore, fees will be discussed on the introductory consultation depending on your particular situation, criteria and goals. 3.2 Unless agreed otherwise, all our charges are inclusive of any applicable value added or other tax. 3.3 We reserve the right to suspend the Coaching Services or terminate the contract between us if our charges are overdue for payment by you. 3.4 For this coaching process to be most effective, you must make a commitment of time and energy and take an active part in the process, this will involve: Specific goals and activities you will be assigned to undertake between sessions: For example, reading, testing, researching, completing and writing accomplishments, activity maintenance, role playing for interviews, networking, designing plans for your goals, practicing new skills and completing your assignments in a timely manner. 4. Warranty and liability 4.1 We warrant to you that the Coaching Services will be provided with reasonable skill and care by coaches who are professional and experienced. 4.2 Nothing in this Agreement shall be construed as restricting or excluding our liability for death or personal injury resulting from our negligence or for fraud. 4.3 Our liability to you under this Agreement shall not exceed the amount paid by you for the Coaching Services. 5. Confidentiality We shall keep all information about you in strict confidence and shall not pass your details to any third party without your written consent 6. General 6.1 No waiver or any amendment to these terms shall be effective unless in writing and signed by both you and us. 6.2 A person who is not a party to these terms may not enforce any of them under the Contracts (Rights of Third Parties) Act 1999. 6.3 If any dispute arises out of these terms we will both attempt to settle it through arbitration. 6.4 This Agreement shall be governed by the laws of the State of California.
